Buddysystemsupport.com is designed to be a peer-led eating disorder support group that does not represent itself as an authority on - nor does it provide any - medical or nutritional expertise.  Buddysystemsupport.com is a resource for peer to peer emotional support only.  No participants in any capacity are health professionals and in no instance should advice, posts or conversations shared as part of buddysystemsupport.com be considered or used as a substitute for professional and medical care. 

To that end, we have set forth these Terms of Service.

By accessing or using the Buddysystemsupport.com website (the “Site”), you agree to the Terms of Service (the “Terms”). The Terms are a legally binding contract between you and Little Plains Media, LLC. "You" means the individual person entering the Terms on his or her own behalf; or, if the Terms is being entered on behalf of an organization, "you" means the organization on whose behalf which this Agreement is entered, and in the latter case, the person entering this Agreement represents and warrants that he or she has the authority to do so on your behalf.

Please read the Terms carefully. By visiting, using or accessing Site, you agree to comply with and be bound by the Terms. If you do not agree with these Terms, you should discontinue use of the Site and Services immediately.

We reserve the right to terminate your use or access to the Services at any time for any reason, including, without limitation, if we learn that you have provided false or misleading information or have violated the Terms.

Privacy

Little Plains Media, LLC respects your right to the right to privacy of the personal information you provide to us on Buddysystemsupport.com.

Safety

We advise you Buddysystemsupport.com is intended to be a safe community, but is still open to the public and you should exercise caution and judgment when posting personal information on the Internet. You may not modify, make derivative works of, disassemble, reverse compile or reverse engineer any part of the Site, or Services or access the Site, or Services in order to build a similar or competitive service. You may not introduce software or automated agents to the Site, or Services so as to produce multiple accounts, generate automated searches, requests, and/or queries, or to strip, scrape, or mine data from the Site, or Services. Without our prior written consent, you may not (a) allow, enable, or otherwise support the transmission of mass unsolicited, commercial advertising or solicitations via e-mail (spam); (b) use any high volume, automated, or electronic means (including without limitation robots, spiders, scripts or other automatic device) to access the Services or monitor or copy our web pages or the content contained thereon; or (c) frame the Site, place pop-up windows over its pages, or otherwise affect the display of its pages. All information that you provide to us will be true, accurate and current.

Termination

We may cancel your account or membership and/or delete your listing if we believe that you have violated or acted inconsistently with the letter or spirit of the Terms. You agree that we will not be responsible to you or any other party for any termination of your access to the Site. You may discontinue your participation in and access to the Services at any time by emailing help.Buddysystemsupport.com

Content

You retain ownership that you have of the content that you post on Buddysystemsupport.com you agree to the following without any additional compensation to you.

Warrantees: You represent and warrant that you won or otherwise control and that no other owns all of the rights to the content that you post or submit for posting on the Buddysystemsupport.com site, that the content is accurate, that it does not violate these Terms and that it will not cause injury to any person or entity.

You grant Buddysystemsupport.com license to your content rights that is non-exclusive, irrevocable, perpetual, worldwide, royalty-free, fully sub licensable, and fully paid-up for any Content that you submit to the Buddysystemsupport.com site.

You grant Buddysystemsupport.com the right to use any material, information, ideas, concepts, know-how or techniques contained in any communication you send to us for any purpose whatsoever, including but not limited to developing, manufacturing and marketing products using such information.

You grant Buddysystemsupport.com the right to use your name, image, voice, likeness or any other personally identifiable information in connection with Content that you submit to Buddysystemsupport.com site

If it is determined that you retain moral rights (including rights of attribution or integrity) in any Content, you hereby declare that a) you do not require that any personally identifying information be used in connection with the Content, or any derivative works of or upgrades or updates thereto; b) you have no objection to the publication, use, modification, deletion and exploitation of the Content by Buddysystemsupport.com or its licensees, successors and assigns; c) you forever waive and agree not to claim or assert any entitlement to any and all moral rights of an author in any of the Content and d) you forever release Little Plains Media, LLC and its directors, officers, employees, stockholders, agents, licenses, successors and assigns from any claims that you could otherwise assert against Buddysystemsupport.com by virtue of any such moral rights.

Buddysystemsupport.com cannot and does not guarantee the accuracy, integrity, or quality of the Content submitted by third parties via the Buddysystemsupport.com site nor does Buddysystemsupport.com control such Content.

You understand that by using the Buddysystemsupport.com site you may be exposed to Content that is offensive, indecent, objectionable, and/or illegal in your jurisdiction. Under no circumstances will Little Plains Media, LLC be liable in any way for Content, including any errors or omissions in any Content. You are responsible for complying with all laws applicable to the Content you submit via the Buddysystemsupport.com site. You may not post, distribute, or reproduce in any way any copyrighted material, trademarks or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights.

You must not post any Content that is not based in fact, is defamatory or libelous in nature, insults or harasses other users of third parties. You may not post Content that falsely expresses or implies that such Content or material is sponsored or endorsed by Little Plains Media, LLC or Buddysystemsupport.com.

You may not post Content that, in the sole discretion of Little Plains Media, LLC and Buddysystemsupport.com violates these Terms, including but not limited to content that: contains vulgar, profane, abusive or hateful language, epithets or slurs, text or illustrations in poor taste, inflammatory attacks of a personal, racial or religious nature, or expressions of bigotry, racism, discrimination or hate Is defamatory, threatening, disparaging, grossly inflammatory, false, misleading, deceptive, fraudulent, inaccurate, unfair, contains gross exaggeration or unsubstantiated claims, violates the privacy rights of any third party, is unreasonably harmful or offensive to any individual or community, contains any actionable statement, or tents to mislead or reflect unfairly on any other person, business or entity, is harassing or advocates harassment; violates any right of Buddysystemsupport.com or any third party; Discriminates on the grounds of race, religion, national origin, gender, age, marital status, sexual orientation or disability or refers to such matters in any manner prohibited by law. Violates any municipal state or federal law, rule, regulation or ordinance, or attempts to encourage such an evasion or violation. Unfairly interferes with any third party’s uninterrupted use and enjoyment of the Buddysystemsupport.com site. Advertises, promotes or offers to trade any goods or services; Includes images, photos, articles or other content that constitutes, promotes or encourages illegal acts, physical harm, violation of any right of any individual or entity, violation of any local, state, national or international law, rule, guideline or regulation, or otherwise creates liability. “inflames” any individual or entity (e.g.ends repeated messages related to another user and/or makes derogatory or offensive comments about another individual) or repeats prior posting of the same message under multiple threats or subjects; Is unrelated to the topic of the area to which it is submitted. Disguises the origin of the post; or Seems or recommends providers of material that exploits in any manner people under the age of 18, or seems or recommends providers that solicit personal information from anyone under the age of 18.

Infringing Content:

If you believe that Content on the Buddysystemsupport.com site infringes your intellectual property rights, send an email to help.buddysystem@gmail.com including:

Identification of the rights you believe to have been infringed, such as a copy or description of a copyrighted work or the specific word, symbol, etc in which you have trademark rights, along with how you came to hold these rights. Identification of the material you believe to be infringing in a sufficiently precise manner to allow us to locate the material, such as the precise url (web address) on which it appeared, along with any copies you have of that web page.

·   Adequate information by which we can contact you (including your name, postal address, telephone number and email address)

·   A statement that you have a good faith belief that use of the material is not authorized by the intellectual property owner, its agent or the law.

·   A statement that the information in the written notice is accurate.

·   A statement under penalty of perjury, that the information in the notice is accurate and that you are authorized to it on behalf of the intellectual property owner, and your physical or electronic signature.

If you knowingly materially misrepresent that material or activity on the Buddysystemsupport.com site is infringing your copyright, you may be held liable for damages, including costs and attorney’s fees. If Buddysystemsupport.com receives a valid notice of infringement of intellectual property rights, Buddysystemsupport.com will promptly remove or disable access to the allegedly offending Content. If you believe that your content was removed by mistake we will give you an opportunity to appeal. If you repeatedly infringe others’ intellectual property rights, we will disable your account.

Buddysystemsupport.com reserves the right, in its sole discretion, to edit, reject, refuse to post or remove any Content (including private messages) including Content you or third-parties have posted. A violation of certain of these Terms may be referred to law enforcement authorities.

Buddysystemsupport.com reserves the right to disclose any information as necessary to satisfy any law, regulation or governmental request without your consent or prior notice to you.

Links and Advertisements

Buddysystemsupport.com does not control third-party advertisements or linked media. You acknowledge that we do not review or monitor any web sites, advertisements, or other media linked to or available through the site and you agree that we are not responsible for the availability of such external services, and that we do not endorse and are not responsible or liable for any content, accuracy, quality, advertising, products or other materials on or available from such services. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, goods, services available on or through such services.

Updates

You agree and understand that these Terms of Service and the Buddysystemsupport.com site may be modified at any time without prior written notice. Your continued use of the Buddysystemsupport.com site after any modifications indicates your acceptance of the modified Terms of Service.

Term

These Terms of Service shall remain in full force and effect while you use the Buddysystemsupport.com site. You may terminate your account at any time, for any reason, by sending an email to help.buddysystem@gmail.com. Little Plains Media, LLC and Buddysystemsupport.com may terminate your account at any time, without warning. Even after your account is terminated and you stop using the Buddysystemsupport.com site, these Terms will stay in effect.

Little Plains Media, LLC, Buddysystemsupport.com and its licensors and affiliates make no representations or warranties of any kind, express, statutory or implied as to the operation of Buddysystemsupport.com or any software, information, content, materials or products included or in association with the Buddysystemsupport.com site to the fullest extent permissible by applicable law. Little Plains Media, LLC and Buddysystemsupport.com and its licensors and affiliates disclaim all warranties, express, statutory or implied including but not limited to implied warranties of merchantability and fitness for a particular purpose and non-infringement. Buddysystemsupport.com and its licensors and affiliates further do not warrant the accuracy or completeness of the information, text, graphics links or other items contained within Buddysystemsupport.com some jurisdictions do not allow limitations on how long an implied warranty lasts, so the above limitations may not apply to you. Buddysystemsupport.com is not responsible for the conduct of any user of the Buddysystemsupport.com site or any other third-party. Buddysystemsupport.com shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond Buddysystemsupport.com reasonable control, including without limitation mechanical, electronic or communications failure or degradation (including ‘line-noise” interference). Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of New York and the United States of America. Any controversy or claim arising out of or related to these Terms shall be settled solely and finally by arbitration administered in New York, New York before one arbitrator selected by the American Arbitration Association. The arbitration shall be conducted in accordance with the expedited procedure rules of the American Arbitration Association, unless the parties agree to different rules of arbitration. Judgment upon the award rendered may be entered in any court with proper jurisdiction.

Indemnity

Buddysystemsupport.com is not allied with any sect, denomination, politics, organization or institution. Buddysystemsupport.com does not wish to engage in any controversy. We neither endorse nor oppose any causes.

You agree to indemnify and hold Little Plains Media, LLC Buddysystemsupport.com its parents, subsidiaries, affiliates, officers, directors, stockholders, agents and employees, harmless, including costs and attorney’s fees from any claim or demand made by any third party due to or arising out of 1) your access or use of the Buddysystemsupport.com site, 2) the violation of the Terms of Service by you (including all other agreements, policies, rules and guidelines referred to herein) or 3) the infringement by you, or any third party using your account or User ID or Password, of any intellectual property or other right of any person or entity.

RESPONSIBILITY FOR DEALINGS WITH THIRD PARTIES

If you are using the Services to find support or medical/nutritional expertise, your correspondence and/or ensuing relationship with nonprofit and public service organizations, professionals, volunteers, partners, advertisers, sponsors or other third parties found on or through the Services (“ Organization"), including posting or acceptance of appointments or meetings, and any other terms or conditions associated with such dealings, are solely between you and the Organization you choose to deal with. YOU AGREE THAT Little Plains Media, LLC and Buddysystemsupport.com WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY LOSS, COST, DAMAGE, OR OTHER LIABILITY OF ANY SORT INCURRED AS THE RESULT OF ANY SUCH DEALINGS, OR AS THE RESULT OF THE PRESENCE OF SUCH PARTIES ON THE SERVICES AND YOU HEREBY IRREVOCABLY WAIVE ANY CLAIMS AGAINST Little Plains Media, LLC and Buddysystemsupport.com ARISING FROM OR RELATED TO YOUR RELATIONSHIP WITH ANY PROFESSIONAL OR ANY VOLUNTEER ORGANIZATION.

YOU AGREE THAT Buddysystemsupport.com WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY LOSS, COST, DAMAGE, OR OTHER LIABILITY OF ANY SORT INCURRED AS THE RESULT OF ANY SUCH DEALINGS, OR AS THE RESULT OF THE PRESENCE OF SUCH PARTIES ON THE SERVICES AND YOU HEREBY IRREVOCABLY WAIVE ANY CLAIMS AGAINST Little Plains Media, LLC and Buddysystemsupport.com and its officers or employees ARISING FROM OR RELATED TO YOUR RELATIONSHIP WITH ANY PROFESSIONAL OR  VOLUNTEER ORGANIZATION.

Release. You hereby release us, our officers, employees, agents and successors from claims, demands any and all losses, damages, rights, claims, and actions of any kind including, without limitation, personal injuries, death, and property damage, that is either directly or indirectly related to or arises from (i) any interactions with other Buddysystemsupport.com users or (ii) your participation in any volunteer activities or activities arising from or related to your use of the Services.

Trademarks

Certain of the names, logos, and other materials displayed in the Services constitute trademarks, trade names, service marks or logos ("Marks") of us or other entities. You are not authorized to use any such Marks. Ownership of all such Marks and the goodwill associated therewith remains with us or those other entities.

Other

The failure of Buddysystemsupport.com to exercise or enforce any right or provision of these Terms of Service shall not operate as a waiver of such right or provision. The section titles in this Agreement are for convenience only and have no legal or contractual effect.

If any provision of this Agreement is unlawful, void or unenforceable, that provision is 1) deemed amended to the extent necessary to conform to the applicable law (or) severable from this Agreement, and does not affect the validity and enforcement of any remaining provisions. These Terms (including all other agreements, policies, rules and guidelines referred to herein) constitute the entire agreement between you and Buddysystemsupport.com regarding the use of the Buddysystemsupport.com site.
